District attorneys have reportedly issued a subpoena to the American Hotel in Sag Harbor, New York, where Justin Timberlake had been drinking before his arrest for drunk driving.
The singer has not yet attended a hearing in his case due to his ongoing tour, and last week Timberlake’s driving license was officially revoked for a year.
Justin Timberlake also pleaded not guilty to the charges against him after his attorney Edward Burke filed a motion to dismiss the charges.
The American Hotel is summoned in Justin Timberlake’s drunk driving case
The American Hotel in Sag Harbor, New York, the luxury hotel where Justin Timberlake went for a drink before his drunk driving arrest, has been served a subpoena to produce evidence.
During the court hearing on Friday, Suffolk County prosecutors said they had issued a subpoena to the hotel.
Prosecutors said the information about the hotel provided through the subpoena would help confirm details of Timberlake’s statements about the night of his arrest.
He allegedly told the police officers who stopped him that he had only drunk “one martini.”
The information is even more valuable to prosecutors because it will help them determine how much the “Mirrors” singer actually drank. This is crucial because Timberlake refused to take a breathalyzer test when he was arrested.
His lawyer, Edward Burke Jr., also claimed that he was not drunk that evening.
Justin Timberlake had his driving license revoked
Timberlake was absent from the latest hearing, which took place a week after his last virtual court appearance on August 2.
During that hearing, the singer was disqualified from driving for one year, in accordance with state law. Judge Carl Irace explained that the basis of his decision was Timberlake’s refusal to submit to a breathalyzer test after his arrest.
According to the Daily MailThe suspension will be the subject of a hearing to determine whether Timberlake’s driver’s license should be revoked entirely.
However, the singer’s suspension could expire in 15 days if the Department of Motor Vehicles (DMV) does not hold a hearing on the case by his next court date.
The New York DMV has a large backlog of registration denial cases, so Timberlake could drive without fear of arrest until the DMV sets a date and holds his hearing. Burke confirmed that he had not been given a date for the DMV hearing as of Friday.
Justin Timberlake pleaded not guilty after trying to dismiss the case
When Timberlake was brought back to court on Friday, August 2, the “Man in the Woods” singer appeared virtually from Belgium. He then pleaded not guilty to the drunken driving charge brought by prosecutors. In the video, Timberlake appeared sober and formal, dressed in a black collared shirt.
The singer’s new charges come after Burke filed a motion to dismiss the case last week, citing errors in the original charging documents that police signed when he was arrested. He argued that the documents were signed by a part-time cop, not a senior officer, and that the Sag Harbor police sergeant who was present at the time should have signed.
Burke also insisted in his dismissal papers that Timberlake was not drunk. Instead of dismissing the case, the judge ordered a retrial under new and revised papers. This was the hearing at which he was disqualified from driving.
Police report shows that a vape pen and other items were found when the singer was arrested
According to police reports, Timberlake was required to complete a walk and turn test. This test requires a person to walk nine steps in a straight line, placing their heel directly in front of their toes each time, then turning around and repeating the process.
However, Timberlake is said to have failed the test. 24-year-old police rookie Michael Arkinson found that the singer was “very unbalanced” and “unable to follow instructions properly.”
When Arkinson arrived at the police station after the arrest, he took inventory of Timberlake’s belongings, which included a Rolex watch, a black vape pen, a gold ring and a wallet containing $306 in cash.
Justin Timberlake’s lawyer was reprimanded for his public comments
During Friday’s hearing, Judge Irace also reprimanded Burke for his comments at the July 26 hearing, calling them “irresponsible.” Burke had spoken to the press outside the courtroom and stated that Timberlake was not drunk at all the night of his arrest.
Judge Irace said the attorney’s statements “give the impression of an attempt to poison the case before it has even begun.”
He warned Burke to be careful with his comments, otherwise he would risk being subject to a news blackout and being unable to speak publicly about the case.
Accordingly People MagazineThe “SexyBack” singer’s next hearing is scheduled for September 13th, but Timberlake does not have to appear in court in person.
